    Terms of Service

    Welcome to On Point Home Inspections ("OPHI," "we," "our," or "us"). These Terms of Service ("Terms") govern your use of our website at www.onpointnyct.com and all services provided by On Point Home Inspections. By accessing our website, requesting services, or signing an Inspection Agreement, you acknowledge that you have read, understood, and agree to be bound by these Terms. If you do not agree, please do not use our website or services.

    1. Services Provided

    On Point Home Inspections provides professional home inspection and related testing services in Connecticut, including but not limited to:

    • Residential home inspections
    • Wood-destroying insect (WDI/WDO) inspections
    • Water quality testing (private well and municipal)
    • Radon testing
    • Mold and air quality testing
    • Septic and sewer scope inspections
    • Well equipment testing
    • Pool and spa inspections
    • Pre-listing inspections and 11-month warranty inspections
    • Reinspections

    All inspection services are governed by a separate written Inspection Agreement that must be reviewed and signed electronically prior to the start of any inspection. The Inspection Agreement contains additional terms, limitations of liability, and scope-of-service details that supplement and are incorporated into these Terms.

    2. Inspection Agreement & Scope of Services

    All inspections performed by OPHI are non-invasive, visual evaluations of the readily accessible components and systems of a property at the time of inspection. Our inspections are conducted in accordance with the applicable standards of practice of our licensing bodies and professional associations.

    The following are not included in a standard home inspection unless separately contracted:

    • Concealed, inaccessible, or underground components
    • Destructive testing of any kind
    • Engineering analysis or structural calculations
    • Code compliance determinations (beyond general reference)
    • Pest, mold, radon, water, or septic testing (separate services)
    • Estimation of remaining useful life of systems or components
    • Future conditions or circumstances

    3. Scheduling & Cancellations

    Inspections may be scheduled online, by phone, or by email. By scheduling an inspection, you represent that you have the legal authority to grant access to the property to be inspected, or that you have obtained such authority from the property owner.

    • Cancellations made with less than 24 hours' notice may be subject to a cancellation fee
    • If access to the property is unavailable at the scheduled time, a re-scheduling fee may apply
    • OPHI reserves the right to reschedule due to weather or other safety concerns

    4. Payment Terms

    Payment for all inspection services is due at or before the time of the inspection. Inspection reports will not be released until the following conditions are met:

    • Full payment has been received
    • The Inspection Agreement has been signed by the client

    We accept all major credit cards, debit cards, and electronic payments. Prices are subject to change based on the size, age, and complexity of the property.

    5. Inspection Reports

    Inspection reports are prepared for the exclusive use of the named client(s) on the Inspection Agreement. Reports reflect conditions observed on the date of the inspection only and are not a warranty, guarantee, or prediction of future performance. Reports are typically delivered the same day or within 24 hours of the inspection.

    Sharing the report with third parties (e.g., real estate agents, sellers, lenders) is at the client's sole discretion and risk. OPHI assumes no liability to any party other than the named client(s).

    6. Limitation of Liability

    To the fullest extent permitted by applicable law, OPHI's total liability to any client for any claim arising out of or related to our services shall be limited to the fee paid for the specific inspection giving rise to the claim. OPHI shall not be liable for:

    • Consequential, incidental, or punitive damages of any kind
    • Conditions not visible or accessible at the time of inspection
    • Conditions that arise or change after the inspection date
    • Errors or omissions in information provided by the client or third parties

    Any legal action arising from an inspection must be commenced within one (1) year of the inspection date.

    7. Website Use

    The content on this website is provided for general informational purposes only. OPHI makes no representations or warranties of any kind, express or implied, about the accuracy, completeness, or reliability of any information on this site. You agree not to:

    • Use this website for any unlawful purpose
    • Attempt to gain unauthorized access to our systems
    • Reproduce, duplicate, or resell any portion of this website without express written permission
    • Use automated tools to scrape or harvest content from this website

    8. Intellectual Property

    All content on this website, including text, images, logos, graphics, inspection report templates, and other materials, is the property of On Point Home Inspections or its licensors and is protected by applicable copyright and intellectual property laws. No content may be copied, reproduced, distributed, or used without prior written consent from OPHI.

    9. Dispute Resolution

    In the event of any dispute arising from our services, the parties agree to first attempt to resolve the matter through good-faith negotiation. If a resolution cannot be reached, the dispute shall be subject to binding arbitration in the State of Connecticut, in accordance with the rules of the American Arbitration Association. These Terms shall be governed by and construed in accordance with the laws of the State of Connecticut, without regard to its conflict of law provisions.

    10. Changes to These Terms

    OPHI reserves the right to modify these Terms at any time. We will update the "Last Updated" date at the top of this page when changes are made. Continued use of our website or services after any modification constitutes your acceptance of the revised Terms. We encourage you to review these Terms periodically.
